This document governs all TOM Enterprise workshops, programs, cohorts, sessions, and related educational content. Please read it fully before participating in any TOM program.

Section 01

Educational Purpose & Scope

TOM Enterprise is an Arizona-based nonprofit creative incubator. All workshops, programs, cohorts, sessions, one-on-one mentorship, group learning experiences, written materials, digital content, and related resources offered by TOM Enterprise (collectively, "TOM Programs") are provided exclusively for educational and informational purposes.

TOM Programs are designed to equip creative entrepreneurs with foundational knowledge and practical frameworks in the areas of brand identity, strategic business planning, and financial literacy. The content delivered through TOM Programs reflects the educational philosophy, experience, and perspective of TOM Enterprise and its facilitators — it does not constitute, and is not a substitute for, professional legal, financial, accounting, tax, investment, psychological, or other licensed professional advice.

Plain language summary: TOM teaches. TOM mentors. TOM equips. TOM does not practice law, provide accounting services, give investment advice, or offer any licensed professional service. Everything you learn in a TOM Program is educational content — apply it with your own judgment, and consult licensed professionals for decisions with significant legal or financial consequences.

By enrolling in, registering for, or participating in any TOM Program — including but not limited to the Legacy Builder Cohort, standalone workshops, Discovery Calls, Strategy Sessions, public events, webinars, and digital resources — you acknowledge that you have read and understood this disclaimer in its entirety and agree to its terms.

Not Professional Advice

Nothing communicated, presented, written, demonstrated, discussed, or implied in any TOM Program constitutes professional advice of any kind. This includes, without limitation:

Legal advice: TOM Programs do not create an attorney-client relationship. No content in TOM Programs should be construed as legal guidance, interpretation of law, or legal strategy. Consult a licensed attorney for any legal matter, including business formation, contracts, intellectual property, employment law, or regulatory compliance.
Financial or investment advice: TOM's financial literacy curriculum teaches foundational concepts to help creative entrepreneurs understand and manage their business finances. It does not constitute financial planning, investment advice, securities guidance, or recommendations specific to any individual's financial situation. Consult a licensed financial advisor or CPA for personal and business financial decisions.

TOM Enterprise makes reasonable efforts to ensure that educational content is accurate, current, and useful. However, laws, regulations, and best practices change. TOM does not warrant that all content is current as of the date of any given program delivery and disclaims responsibility for any action taken based on program content without independent professional verification.

Section 03

No Guaranteed Results

TOM Enterprise is committed to delivering high-quality educational programming and meaningful mentorship. TOM measures and publicly reports on program outcomes through its Impact reporting. However, TOM makes no guarantee, warranty, or representation that participation in any TOM Program will produce any specific business outcome, financial result, revenue level, client acquisition, brand recognition improvement, or other measurable result.

Business outcomes depend on a complex combination of factors — many of which are entirely outside TOM's control and within the participant's own responsibility. These factors include, without limitation:

The participant's consistent application of program frameworks to their specific business context
The participant's level of engagement, attendance, and effort throughout the program
Market conditions, competitive dynamics, and economic factors in the participant's industry and geography
The participant's prior experience, skills, network, and resources independent of TOM programming
The participant's personal circumstances, availability, and life events during and after the program
The quality and timing of decisions made by the participant independent of TOM's guidance

Outcome data transparency: TOM's publicly stated impact targets — including the 75% launch-or-advance metric and the 85% cohort completion rate target — are goals and projected outcomes based on program design, not guaranteed results. TOM publishes actual longitudinal outcome data as it becomes available. The distinction between targets and verified outcomes will always be clearly labeled in all TOM communications.

Any testimonials, founder stories, or outcome examples presented in TOM's materials represent individual experiences and are not necessarily typical. Past participant outcomes do not predict or guarantee future participant outcomes.

Section 04

Artificial Intelligence — Use, Limitations & Transparency

TOM Enterprise uses artificial intelligence tools across its operations, including but not limited to content drafting, intake triage, scheduling support, internal workflow automation, and the generation of educational materials. This section constitutes TOM's AI Disclaimer Addendum and governs the use of AI-generated content in all TOM Programs and communications.

4.1 — AI Content in TOM Programs

Some content delivered through TOM Programs, including written materials, frameworks, onboarding documents, blog posts, email communications, and workshop primers, may be drafted or assisted by AI language models. TOM's policy is as follows:

All AI-assisted content is reviewed by TOM staff or the Executive Director before delivery. AI is used as a drafting and efficiency tool — not as an autonomous decision-maker or content publisher.
AI does not make enrollment, scholarship, or rejection decisions. All Surgical Logic scoring interpretations, cohort enrollment decisions, scholarship awards, and program acceptance or denial decisions are made by Tralynn M., Executive Director, personally.
AI-generated content may contain errors. Despite review processes, AI tools can produce inaccurate, outdated, or incomplete information. TOM disclaims liability for any error, omission, or inaccuracy in AI-generated content that was not identified during human review.
AI does not replace professional expertise. Where TOM's AI tools reference legal, financial, medical, or other professional domains, those references carry the same educational-only disclaimer as all other TOM content (see Section 02).

4.2 — Named AI Agents

TOM Enterprise operates a set of named internal AI agents that assist with specific operational functions. For transparency, their roles are disclosed here:

Eva — Executive assistant; routing, scheduling, triage, and organizational planning support
Stan — Sales and pipeline support; intake scoring assistance and outreach drafting
Linda — Legal and compliance drafting assistance; policy language, waivers, and terms drafting. Linda is not a lawyer. Linda's output is not legal advice.
Penny — Content and onboarding; blog drafts, onboarding documents, primers, and syllabi
Sonny — Social media and campaign support; post copy, captions, and content calendar assistance

All named AI agents operate under the authority and final review of the Executive Director. Their outputs are drafts and assistance tools — not autonomous decisions, professional opinions, or binding organizational commitments. Any TOM communication that appears to come from a named AI agent carries this disclaimer by incorporation.

4.3 — Participant Data and AI

TOM does not use participant personal information, application responses, or session content to train external AI models. Application data and session records are managed within TOM's secure CRM (HubSpot) and are subject to TOM's Privacy Policy. Participants may request information about how their data is stored and used by contacting tralynnm@tomenterprise.org.

Section 05

Participation Terms & Conduct

Participation in any TOM Program is conditioned on adherence to TOM's participation terms. By enrolling in or attending any TOM Program, participants agree to the following:

Respectful engagement: TOM Programs create a shared learning environment. All participants are expected to engage with facilitators and fellow participants with respect, honesty, and professionalism. TOM reserves the right to remove any participant from a program for conduct that disrupts the learning environment, violates the dignity of other participants, or is otherwise incompatible with TOM's Community First values.
Confidentiality of peers: Cohort participants may share personal business information, financial details, and personal stories in group sessions. Participants agree to treat all peer disclosures as confidential and not to share, publish, or discuss peer information outside the program context without explicit permission.
Recording policy: TOM may record live sessions for internal quality review and to provide session recaps to enrolled participants who miss a session. Participants will be notified when a session is being recorded. Participants may not independently record TOM sessions without written permission from TOM Enterprise.
Attendance and commitment: The Legacy Builder Cohort requires consistent attendance and engagement. Participants who miss more than three consecutive sessions without prior communication may be administratively withdrawn from the cohort, subject to TOM's refund policy as communicated at enrollment.
Honest representation: Participants are expected to represent their business, financial situation, and personal circumstances honestly in application materials and during program participation. Misrepresentation — particularly in scholarship or sliding-scale applications — is grounds for removal from the program without refund.
Section 06

Intellectual Property

All TOM Enterprise program materials — including but not limited to curricula, frameworks, worksheets, slide decks, written guides, video recordings, brand assets, and digital resources — are the intellectual property of TOM Enterprise and are protected by applicable copyright and intellectual property law.

Personal use license: Enrolled participants receive a limited, non-exclusive, non-transferable license to use TOM program materials for their own personal business development purposes during and after the program.
No redistribution: TOM program materials may not be reproduced, distributed, resold, sublicensed, published, or shared — in whole or in part — without written permission from TOM Enterprise.
Participant work product: All brand identity deliverables, business plans, and other work product created by participants during TOM Programs belong to the participant, not to TOM. TOM does not claim ownership over any founder's business, brand, creative work, or intellectual property developed during the program.
Testimonials and stories: TOM may request permission to use participant testimonials, outcome stories, or Demo Day materials for promotional and fundraising purposes. Such use requires explicit written consent from the participant and will always be honored with accurate attribution. Participants are never required to provide testimonials as a condition of participation.

Your work is yours. Always. TOM's role is to help you build your brand and business — not to claim any stake in it. The frameworks TOM teaches belong to TOM. The business you build using them belongs entirely to you.

Section 07

Limitation of Liability

To the fullest extent permitted by applicable law, TOM Enterprise, its Executive Director, staff, facilitators, mentors, volunteers, contractors, and AI tools shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to:

Participation in or reliance upon any TOM Program content, advice, framework, or material
Any business decision made by a participant based on TOM educational content
Any failure to achieve expected or desired business outcomes following participation in a TOM Program
Any error, omission, or inaccuracy in TOM program materials, including AI-generated content
Any technical failure, platform outage, or scheduling disruption affecting program delivery
Any third-party content, tools, or services referenced or recommended during TOM Programs

In no event shall TOM Enterprise's total liability to any participant exceed the amount actually paid by that participant to TOM Enterprise for the specific program giving rise to the claim.

Note: Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, TOM's liability is limited to the maximum extent permitted by law. This disclaimer does not affect any statutory rights you may have that cannot be waived or limited by contract.

This limitation of liability applies regardless of the form of action — whether in contract, tort, negligence, strict liability, or otherwise — and regardless of whether TOM Enterprise has been advised of the possibility of such damages.

I understand that TOM Enterprise is an educational nonprofit. All content delivered through TOM Programs is for educational and informational purposes only and does not constitute professional legal, financial, accounting, tax, or psychological advice.

I understand that results are not guaranteed. My outcomes depend on my own effort, decisions, circumstances, and factors outside TOM's control. TOM's impact targets are goals and projections — not promises.

I understand that TOM uses AI tools. Some content I receive may be AI-assisted, reviewed by TOM's Executive Director, and subject to the AI Disclaimer Addendum in Section 04 of this document. AI does not make decisions that affect my enrollment, scholarship status, or program participation.

I agree to participate honestly and respectfully. I will keep peer disclosures confidential, represent my situation truthfully, and engage with TOM's community in a manner consistent with TOM's values.

I understand that my work is mine. TOM does not claim ownership over any business, brand, or creative work I develop during or after a TOM Program.
